Why use a solicitor for your RTM?
- Your freeholder will probably instruct a solicitor to act for him or her on receipt of the Claim Notice. A solicitor acting on your behalf would ensure that your interests are protected to the fullest extent and will put you on an equal footing with your freeholder.
- The law relating to the right to manage is complex. Many areas of law impinge on the right to manage, apart from the Commonhold and Leasehold Reform Act 2002. Solicitors are qualified to advise on all aspects of the law affecting the right to manage.
- Practising solicitors are regulated by the Solicitors Regulation Authority which imposes stringent criteria on solicitors’ practices. Under the Solicitors’ Code of Conduct, solicitors are required to:-
- have a minimum of £2 million professional indemnity insurance
- undertake at least 16 hours per annum continuing professional development to keep abreast of changes in the law
- maintain a client care procedure in the unlikely event that things go wrong

Choosing and using a Property Managing Agent
When you acquire the right to manage, you will have the ability to choose whether to manage the block yourselves or to appoint a professional Property Managing Agent of your own choosing.
If you choose to appoint a Property Managing Agent, we recommend that you choose a member of the Association of Residential Managing Agents (ARMA) which is the only body in England and Wales to focus exclusively on matters relating to the management of residential leasehold blocks of flats. Members of ARMA will have had to satisfy an independent body of their competence.
